Parental Responsibility (PR)

When a baby is born, a Mother has automatic PR, as does a Father if he is married to the Mother. When the baby is registered, unmarried Fathers have PR if they are named on the baby’s birth certificate. PR can also be granted to a Father by the Court. Parental responsibility is defined in law as “all the rights, duties, powers, responsibilities and authority, which by law a parent has in relation to the child and the administration of his/her property.” If a Local Authority is granted a Care Order by a Court, they then share PR with the parents, though the final ‘say’ on decisions is down to the Local Authority.
